Heres the text of the letter the FCC sent to WVTV regarding their extension petition:
Dear Permittee:
This letter is with respect to the above-referenced request for extension of time to
construct digital facilities for station WVTV-DT, Milwaukee, Wisconsin.
On April 24, 2001, WVTV Licensee, Inc. (WVTV) received a permit to construct digital
facilities on station WVTV-DT. In its FCC Form 337, WVTV asserts that it has been unable to
construct DTV facilities for technical reasons, stating that the existing WVTV tower is not
capable of supporting a DTV antenna system and that a new community tower has been
constructed. According to WVTV, it "is in the final stage of lease negotiations, . . . [t]he antenna
system and DTV transmitter are on order, and specific antenna mounting and transmitter
equipment are ready." WVTV, however, does not provide a date by which it anticipates
construction will be undertaken or completed.
In the DTV proceeding, the Commission announced its willingness to grant, on a case-by-
case basis, an extension of the applicable DTV construction deadline where a broadcaster has
been unable to complete construction due to circumstances that are either unforeseeable or
beyond the permittee's control, provided the broadcaster has taken all reasonable steps to resolve
the problem expeditiously.1 The FCC Form 337 requires that an applicant seeking an extension
of time must provide specific reasons in support of an extension, as well as the specific steps it
has taken to mitigate any problems.
We find that WVTV’s extension request is deficient, and accordingly, request further
information. Specifically, WVTV is requested to amend its previously filed FCC Form 337
within fifteen (15) days from the date of this letter to provide: (1) information regarding the
status of its tower lease negotiations, and a firm date by which negotiations will be completed;
(2) a specific plan outlining how it will use the extension time to further the construction of
WWTV-DT; and (3) the date upon which it anticipates that construction will be complete.
